Mac Miller Being Sued For $150,000 For Stealing From Obscure 70’s Funk Band

Aquarian Dream claims that Miller used a song from their album in last year’s mixtape ‘Faces’.

Pittsburgh rapper, Mac Miller, is being sued once again, this time for use of a song he gave away for free on his 2014 mixtape ‘Faces’.

1970’s funk band, Aquarian Dream, filed a lawsuit in U.S District Court for the Central District of California on Wednesday, seeking $150,000 in damages. The band claims that Miller used their 1978 song ‘Yesterday (was so nice today)' without permission on the track ‘Therapy’.

‘Therapy’, which Miller gifted to his fans, has been downloaded over 700,000 times.

According to Larry Zerner, a Los Angeles-based lawyer, the fact that Miller didn’t profit from the release doesn’t matter.

"If I stood on a corner and gave away 700,000 copies of Mac Miller's CD, would he be upset? The fact that he gave it away does not mean my client was not damaged. It's a sample and artists tend to get paid for samples. And it's not just a sample, he raps over the whole song."

E. Dan, the producer at Pittsburgh’s ID Labs where ‘Faces’ was created, obviously had a different take on the matter.

"When this gets settled…they ought to determine a dollar amount for the publicity gained and subtract that from the total Mac owes them," he commented.

"Interesting that they always seem to go after Mac for this stuff when there's hundreds of songs coming out every month with uncleared samples."
