Last summer, the Beastie Boys were awarded $1.7 million from Monster Energy Drink over a dispute regarding unauthorized use of their music. Now, less than a year later, the band is seeking an additional $2.4 million in restitution.
According to the Beastie Boys, Monster used evasive legal techniques, forcing them to accumulate an enormous amount of los funds in lawyer fees.
“Monster’s tactics significantly increased the costs for Beastie Boys to vindicate their intellectual property right, such that, absent an award of attorney’s fees and costs, plaintiff’s success at trial would become a Pyrrhic victory,” wrote the band’s legal team in a filing over the weekend.
During the initial trial, Monster admitted to using snippets of Beastie Boys’ ‘Sabotage’, ‘So What’cha Want’, ‘Make Some Noise’ and ‘Looking Down the Barrel of a Gun’ for an online promotional video.
Beastie Boys, understandably so, do not appreciate having their songs used without permission… but the issue angers them more than many musicians due to Adam Yauch’s final wishes.
In his will, original member Yaunch stipulated that the band could never license their music to endorse products.
The new case will most likely go to court later in the year.
